Membership Terms & Conditions

Upon becoming a member or casual attendee of Kadampa Meditation Centre Auckland, you agree to abide by the following membership terms and conditions.

Kadampa Meditation Centre, Auckland Inc: General

  • All members will abide by the code of conduct set out in the Centre rules. This is to ensure all members and attendees may quietly enjoy the classes and activities of Kadampa Meditation Centre Auckland.
  • Attendance for children under 16 is free. Children must be supervised at all times by a parent or guardian.
  • Admittance to the centre or class venue is during opening hours and published class schedules. Arrangements for volunteers for entry outside these hours is at the discretion of management.
  • Management will not be held responsible for any accident of injury suffered, or any loss or damage sustained to members or their personal property while using the facilities. However, Kadampa Meditation Centre Auckland will maintain high standards of the health, safety and wellbeing of all attendees.
  • Persons sixteen years of age and above are offered all membership entitlements. Payment is by automatic payment via internet bank transfer on the first of every month. Membership is for a minimum of three months and can be terminated after three months with one months notice in writing. Membership fees are non – refundable.

Formal Terms and Conditions of Membership Agreement

This agreement is for Membership giving access to classes organised by Kadampa Meditation Centre Auckland Inc throughout Auckland, Hamilton and Tauranga. Management reserve the right to add or remove classes at any time.

1. Acceptance of Risks, Exclusions of Liability and Indemnity:

The individual acknowledges that attendance at classes and events organised by Kadampa Meditation Centre Auckland may in unusual circumstances involves risk of injury and/or illness and/or damage to or loss of personal property and agrees, to the extent permitted at law, that by attending these classes they personally assume those risks. Kadampa Meditation Centre Auckland Inc shall not be liable any direct, indirect or consequential liability, claims, losses, damages, or expenses whatsoever and howsoever arising (“losses”) in relation to the risks set out above, except to the extent Kadampa Meditation Centre Auckland Inc is liable under applicable law for losses caused by Kadampa Meditation Centre Auckland Inc or any of its personnel’s gross negligence, breach of this Agreement, or breach of any applicable law. Nothing in this clause is intended to have the effect of contracting out of the Health and Safety at Work Act 2015 or the Consumer Guarantees Act 1993 except to the extent permitted by either of those Acts, and this clause only applies to the extent permitted by law.

The individual indemnifies Kadampa Meditation Centre Auckland Inc against all liability to any person or persons howsoever arising from my use of the Facilities, except to the extent such liability is caused by Kadampa Meditation Centre Auckland Inc or any of its personnel’s gross negligence, breach of this Agreement, or breach of any applicable law.

2. Collection & Use of Personal Information and Privacy Act:

I agree to Kadampa Meditation Centre Auckland collecting, holding, using and disclosing my personal information for the purposes of this Agreement. I acknowledge that I have a right under the Privacy Act 1993 to access and request correction of any personal information held by Kadampa Meditation Centre Auckland Inc in relation to me.

3. Termination and/or Suspension of Membership:

I accept that Kadampa Meditation Centre Auckland Inc may, acting reasonably, and by providing me with reasonable notice, close (either temporarily or permanently), relocate or redevelop the Centre Classes and events and that my membership may be terminated or suspended.

I agree that I can only terminate this agreement by written notice to Kadampa Meditation Centre Auckland Inc.

If my membership is suspended due to my breach of this Agreement, I agree that my membership fee is non-refundable.

4. Exclusions, Transfer and Upgrades:

  • Each membership tier benefits are as published in the website, brochure and other official communications of the centre.
  • Management reserves the right to offer additional benefits or vary benefits from time to time.
  • Excluded for all membership categories: National Events and NKT – IKBU Festivals and Dharma Celebrations, Day/ evening/ weekend Courses with authorised NKT- IKBU KMC Teachers resident outside of Auckland. Retreats held in external venues. All Public Talks are excluded, Empowerments.
  • Starter membership Exclusions: Study Programme, Weekend/ Day course/ morning workshops, Retreats, Exclusive Benefactor gatherings.
  • Friend membership Exclusions: Full Day workshop( but does include 20% discount), Retreats, Exclusive Benefactor gatherings
  • Membership transfer is not permitted.
  • Memberships may be gifted but the minimum 3 month rule applies.
  • By payment of the appropriate additional fee members may upgrade their membership category to a higher level.
  • Members may downgrade their membership level but membership fees paid are non refundable.

5. Payment of Membership Fees:

  • If I have chosen to pay the Membership Fees annually by lump sum, I agree to pay the membership fee for the full term of my membership immediately.
  • If I have chosen to pay monthly ( most popular arrangement) , then I will ensure that the fees under this Agreement are paid in accordance with the instalment arrangements.
  • Fees are normally due on the 1st of the Month by automatic payment.
  • If I fail to pay any instalments for any reason Kadampa Meditation Centre Auckland Inc may either add the outstanding sum to the next instalment or request immediate payment.
  • Payment by eftpos or cash for memberships is not permitted
  • I understand that I will not be entitled to enter or use the classes and will be required to pay casual fees for attendance at classes at any time when my membership fee has not been paid up to date.

6. Complete and Accurate Disclosure: I agree that all information given by me to Kadampa Meditation Centre Auckland Inc is truthful, complete and accurate.

7. Right to Cancel: How to cancel: If I want to cancel this membership arrangement I must give written notice to Kadampa Meditation Centre Auckland Inc. I must also pay the casual class rate of any classes attended within 15 working days of the day I give notice. Time limits for cancellation: Within 7 days of taking out a membership and receiving confirmation.

8. Entire Agreement: I agree that these terms and conditions is the entire membership agreement between me and Kadampa Meditation Centre Auckland Inc. and supersedes and cancels all previous membership agreements, understandings and arrangements (whether implied or made expressly).

9.Invalid clauses: If any part of this Agreement is held to be invalid, unenforceable or illegal for any reason, this Agreement will be deemed to be amended by the addition or deletion of wording necessary to remove the invalid, unenforceable or illegal part, but otherwise to retain the provisions of this Agreement to the maximum extent permissible under applicable law.
